Third-Party Tools: For certain services, we may use third-party tools such as Showit, ThriveCart, Envato Elements, Dupe, or Honeybook. While we ensure these tools are reliable, Inspire Digital is not responsible for any issues arising from the use of third-party platforms.
3. Intellectual Property
All content created by Inspire Digital, including but not limited to website design, branding, logos, graphics, and written content, is the intellectual property of Inspire Digital unless otherwise agreed upon in writing.
Client Ownership: Upon full payment, you will receive ownership rights to the final design files provided by Inspire Digital unless otherwise agreed upon. Inspire Digital retains the right to showcase the work in our portfolio and marketing materials.
License to Use: By purchasing any of our templates or services, you are granted a non-exclusive, non-transferable license to use the provided assets for your business only.
4. Template Sales
Inspire Digital provides pre-designed templates for Showit.
No Resale: Templates purchased from Inspire Digital cannot be resold or redistributed under any circumstances.
Support: Basic support for template customization is provided; however, extensive customization beyond the scope of the original design may incur additional charges.
Non-Refundable: Due to the digital nature of templates, all sales are final, and refunds are not available once a template has been downloaded.
5. User-Generated Content
By submitting any user-generated content (UGC) such as testimonials, reviews, or social media content that showcases our work, you grant Inspire Digital a non-exclusive, royalty-free, perpetual license to use, reproduce, and modify such content in our marketing and promotional efforts.
6. Payment and Refund Policy
Payment Terms: All payment terms for custom services are outlined in the contract signed by the client and Inspire Digital. Payments are typically due in installments, with the first installment required upfront to begin work.
Non-Refundable Deposits: Deposits are non-refundable. If you cancel services after work has begun, no refunds will be issued for completed work.
Refunds: Due to the nature of digital services, refunds are not provided once the project has begun, unless otherwise stated in a separate written agreement.
7. Limitation of Liability
Inspire Digital is not responsible for any direct, indirect, or incidental damages resulting from the use or inability to use our website or services, including but not limited to lost profits, business interruption, or loss of data.
We make no warranties, expressed or implied, regarding the accuracy, reliability, or completeness of the information provided on our website or in our services.
8. Confidentiality
Both parties agreeto maintain the confidentiality of all proprietary information, including any personal or business-related information shared during the course of a project. This obligation remains even after the completion of services.
9. Termination
Inspire Digital reserves the right to terminate any service or agreement if the client violates these terms or engages in unethical or illegal activities. Termination will be communicated in writing, and any outstanding payments will become immediately due.
10. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Ontario, Canada. Any disputes arising from the use of this website or services will be resolved through binding arbitration in accordance with the laws of Ontario, Canada. For international clients, local consumer protection laws may also apply.
